Visa retrogression occurs when the demand for visas exceeds the limits set by the U.S. government. It has a profound effect on the nursing profession which falls into the large EB-3 subcategory alongside workers in many other fields, as well as applicant’s family members. EB-3 includes all occupations that require at least an associate’s degree but not a master’s degree.
Recent estimates calculate that due to visa retrogression, the arrivals of at least 10,000 foreign nurses have been postponed indefinitely. Understanding Visa Retrogression
The immigration process is lengthy, testing the patience of individuals seeking a new chapter in their lives. Visa retrogression adds a layer of complexity, occurring when the demand for visas surpasses the allocated yearly quota. With the issuance of priority dates determining an applicant’s place in line, retrogression leads to waiting periods while application backlogs are cleared. Currently, only applicants from the Philippines and all Chargeability Areas who filed before January and February of 2023 (depending on their home country) can move through their application process with the USCIS (United States Citizenship and Immigration Services) until Case Complete. Applicants from the Philippines and all Chargeability Areas with a priority date of September 8, 2022, or before can receive an embassy interview date and visa issuance.

This ensures they are ready to schedule their embassy interviews as soon as retrogression lifts for their priority date – placing them back on the path to arrive in the U.S.

Our nurses maintain their connection with Immigration Specialists, enabling us to navigate the process up to Case Complete and address any questions or concerns during the waiting period. For those most recently affected, Shearwater initiates the Visa Screen Application and English exam processes, ensuring readiness for progress when retrogression lifts. Monthly communication updates keep all in-process nurses informed and engaged.
